1. Introduction

Aymar Agent is an AI-powered automation platform that assists with various organic growth activities, including but not limited to SEO, outreach and cold email automation, content creation, social media posting, and backlink outreach. The platform is designed to automate workflows and assist with these activities.

AymarTech provides the platform and tools to facilitate these activities, but does not guarantee specific business results, outcomes, or performance metrics. Results depend on numerous factors outside of AymarTech's control, including but not limited to market conditions, competition, user implementation, and external platform policies.

3. Eligibility

To use Aymar Agent, you must:

• Have the legal capacity to enter into a binding agreement
• Use the service for lawful business purposes only
• Comply with all applicable laws and regulations in your jurisdiction

If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Responsibilities

By using Aymar Agent, you agree to:

• Provide accurate, current, and complete information when creating and maintaining your account
• Use the platform in a legal and ethical manner
• Not misuse automation features for spam, abuse, harassment, or any illegal activities
• Comply with all applicable laws, including but not limited to anti-spam laws, data protection regulations, and intellectual property laws

5. Subscription & Payments

Aymar Agent is offered on a subscription basis. By subscribing, you agree to pay the fees associated with your chosen subscription plan.

• Payments are processed through iyzico, our payment processor
• Subscription fees are billed in advance on a recurring basis according to your selected plan
• We reserve the right to change our pricing with reasonable notice to existing subscribers
• You may cancel your subscription at any time through your account settings
• No long-term contracts are required; subscriptions operate on a month-to-month basis unless otherwise specified
• Refunds are handled in accordance with our refund policy, which may vary by subscription plan
• If payment fails or your subscription expires, access to the service may be suspended until payment is successfully processed

6. Intellectual Property

The Aymar Agent platform, including all software, infrastructure, designs, text, graphics, logos, and other content, is owned by Aymar Teknoloji A.Ş. and is protected by intellectual property laws.

You retain ownership of any content, data, or materials you create, upload, or provide through the platform. By using the service, you grant AymarTech a limited license to use, store, and process your content solely for the purpose of providing and improving the service.

These Terms do not grant you any rights to use AymarTech's trademarks, logos, or other proprietary materials beyond what is necessary to use the service. No rights are transferred to you beyond the limited right to use the platform in accordance with these Terms.

7. Disclaimer of Guarantees

AymarTech makes no guarantees, representations, or warranties regarding:

• Specific business results, outcomes, or performance metrics
• Traffic, rankings, leads, revenue, or any other business metrics
• The accuracy, completeness, or usefulness of automated outputs
• Uninterrupted or error-free operation of the platform
• The compatibility of the service with all third-party platforms or services

Results depend on many external factors outside of AymarTech's control, including market conditions, competition, user implementation, third-party platform policies, search engine algorithms, and other variables. AymarTech provides tools and automation capabilities but cannot guarantee specific outcomes.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AymarTech and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of goodwill
• Costs of substitute services
• Any damages arising from your use or inability to use the service

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Termination

AymarTech reserves the right to suspend or terminate your account and access to the service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Misuse of the platform or its features
• Illegal or unethical activities
• Non-payment of subscription fees
• Any activity that may harm AymarTech, other users, or third parties

You may stop using the service at any time by canceling your subscription. Upon termination, your right to use the service will immediately cease. We may delete your account and data in accordance with our data retention policies.

10. Modifications

AymarTech reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the service after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the service and cancel your subscription.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Turkey.
